At Cheeky Glutes Nutrition, your wellness journey is personal — and so is your privacy. We believe in transparency, trust, and protecting the information you share with us as part of your health and fitness goals. This policy explains how we collect, use, and safeguard your data, including Consumer Health Data and Mobile Information, in full alignment with applicable state and federal privacy laws.

1. Mobile Messaging & TCPA Compliance (GoHighLevel Terms)

By providing your phone number and opting in to receive text messages from Cheeky Glutes Nutrition, you agree to the following Mobile Terms:

  • Express Consent: By opting in via our website forms, quizzes, checkout pages, or keyword triggers, you provide your express written consent to receive recurring automated marketing, promotional, and transactional text messages (e.g., cart reminders, wellness tips, order updates) from Cheeky Glutes Nutrition.
  • Automation Disclosures: Messages may be sent using an automatic telephone dialing system (ATDS) or other automated technology via our CRM provider, GoHighLevel. Consent to receive automated text messages is completely voluntary and is not a condition of purchase.
  • Message and Data Rates: Message and data rates may apply depending on your mobile carrier plan. Message frequency varies based on user engagement and campaign types.
  • How to Opt-Out (STOP): You can cancel the SMS service at any time. Text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message you receive from us to opt out. You will receive one final text message confirming that you have been unsubscribed, and no further messages will be sent unless you re-initiate opt-in.
  • How to Get Help (HELP): For support or questions regarding our mobile messaging program, text HELP to any message you receive, or email us directly at hi@cheekyglutes.com.
  • Strict Carrier Privacy Protection:Mobile Information Sharing: No mobile information, phone numbers, or opt-in data will be shared, sold, or rented to third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

2. Consumer Health Data Privacy Policy Overview

This section describes how Cheeky Glutes Nutrition (“Cheeky,” “we,” Our,” or “us”) collects, uses, and protects Consumer Health Data of individuals (“you”) residing in states such as Connecticut, Washington, or Nevada, in accordance with the Connecticut Data Privacy Act, Nevada’s Consumer Health Data Privacy Law, and the Washington My Health My Data Act (collectively, the “Consumer Health Data Privacy Laws”).

This Health Privacy Policy supplements Cheeky’s general Privacy Policy. Any capitalized terms not defined here will have the meaning provided in our Privacy Policy or in the applicable Consumer Health Data Privacy Law.

Collection of Consumer Health Data

“Consumer Health Data” generally includes personal information that is linked or reasonably linkable to you and that identifies, or could be used by Cheeky to identify, your past, present, or future physical or mental health status. This may include, for example, wellness goals, fitness habits, or supplement preferences. Consumer Health Data does not include information that is publicly available, de-identified, or aggregated.

Categories of Consumer Health Data We Collect

The types of Consumer Health Data we may collect include:

  • Information you share with us about your health, wellness, or nutrition goals.
  • Information collected through quizzes, product recommendation tools, or surveys.
  • Purchase or usage information that may relate to your fitness or wellness preferences.

Our Purposes for Collecting and Using Consumer Health Data

We may collect, use, or process your Consumer Health Data as reasonably necessary to:

  • Provide you with products or services that support your health and fitness goals.
  • Offer personalized product recommendations or wellness insights.
  • Improve our products, services, and educational content.
  • Comply with applicable laws and regulations.

We do not engage in geofencing around health care facilities in Washington, nor do we track or identify consumers seeking health care services or send targeted advertisements based on health-related locations.

We may also create aggregated, de-identified, or anonymized data from the Consumer Health Data we collect. This data will not identify you personally and may be used for lawful business purposes such as analytics, research, and improving our products and brand.

We do not sell your Consumer Health Data as defined by the applicable Consumer Health Data Privacy Laws.

3. How We Disclose Your Consumer Health Data

We may disclose your Consumer Health Data as reasonably necessary to the following categories of parties:

  • Service Providers and Vendors: We may share data with partners who help us operate our website, provide analytics, process payments, or deliver products and services (including our CRM and SMS platform providers, subject to the strict mobile sharing limitations detailed in Section 1).
  • Business Partners: We may share limited data with marketing or collaboration partners only when you have provided explicit consent.
  • Legal or Regulatory Authorities: We may disclose data to comply with legal obligations, court orders, or government requests, or to protect the rights and safety of you, Cheeky, or others.
  • Corporate Transactions: In the event of a merger, acquisition, or sale of assets, your data may be transferred as part of that transaction.

4. Your Consumer Health Data Rights

Depending on your state of residence, you may have certain rights regarding your Consumer Health Data. These rights may include:

  • Access and Portability: Request confirmation of, or access to, the Consumer Health Data we maintain about you. Washington and Nevada residents may request a list of third parties or affiliates with whom data has been shared. Connecticut residents may request a copy of their data in a machine-readable format.
  • Correction: Request corrections to inaccurate Consumer Health Data (applicable to CT residents).
  • Deletion: Request deletion of your collected Consumer Health Data.
  • Withdraw Consent: Withdraw consent for data collection or disclosure (note: this may limit our ability to provide certain products or services).
  • Opt-Out: Opt out of the sale or use of data for targeted advertising or profiling. (Cheeky does not currently engage in these activities).
  • Nondiscrimination & Appeal: We will not discriminate against you for exercising your rights. If a data request is denied, you have the right to appeal our decision or contact your state’s Attorney General.

5. How to Exercise Your Rights

To exercise your rights, you must submit a Valid Request, which includes:

  1. Sufficient information for us to verify your identity and relationship with Cheeky (such as your name, contact email, or order number).
  2. A clear description of your request.
